Divorce mortgage planning

Before agreeing who keeps the home, ask how the financing will work.

A proposed settlement is more useful when the mortgage questions have been explored while there is still time to adjust the plan.

Translate the proposal into financing questions

If one spouse hopes to retain the home, the team needs a clear picture of the proposed ownership, existing mortgage, potential equity payment, available funds, and intended timeline. These details frame the mortgage analysis.

Explore the proposed path early

Is the team considering refinancing, an equity buyout, or an assumption? Each path needs its own review. Availability, qualification, timing, and any release of liability should be investigated rather than assumed from the proposed agreement.

Coordinate the information

Income, support arrangements, assets, liabilities, and settlement timing may affect the proposed financing. I work with the homeowner and, with authorization, their attorney, mediator, or financial professional to identify the questions requiring further review.

Keep the settlement and mortgage analysis connected

As a CDLP®, my role is to help evaluate mortgage options and communicate potential obstacles before decisions are final. I do not provide legal or tax advice, and a planning discussion is not a commitment to lend. The goal is a better-informed conversation while alternatives remain available.

This article is for general education. It is not legal, tax, investment, or individualized financial advice, a loan approval, or a commitment to lend. Requirements and availability vary by lender and program.

A good mortgage plan starts with a conversation.
